Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020

Under new government legislation, landlords are legally required to ensure all fixed electrical installations in their rental properties are inspected and tested by a qualified professional at least once every five years.

The Regulations mandate that landlords:

  • Obtain an EICR (Electrical Installation Condition Report) following the inspection.
  • Provide tenants with a copy of the EICR within 28 days of the inspection.
  • Retain the EICR until the next inspection is due.

Additionally, upon request, landlords must supply a copy of the report to the local housing authority within 7 days.

Key Dates for Compliance

  • 1st July 2020 – New Tenancies:
    Landlords must supply tenants with a satisfactory EICR before the tenancy begins.

  • 1st April 2021 – Existing Tenancies:
    Landlords must provide current tenants with a copy of a satisfactory EICR.

Enforcement and Penalties

Local housing authorities are responsible for enforcing these rules and have the power to arrange remedial actions if necessary. Breaching the Regulations can result in financial penalties of up to £30,000.
